SENATE CONCURRENT RESOLUTION NO. 19

Requesting the Joint Committee on Government and Finance review,
examine and study the feasibility of requiring a deposit on
certain beverage products.

Whereas, The problem of the proper disposal of empty beverage
containers of all kind presents an environmental problem to West
Virginia, including littering, cleanup, law enforcement,
beautification and concerns for citizens' health and safety; and

Whereas, A procedure for requiring the use of returnable
containers, deposits and redemption of bottle or container deposits
may well provide a viable solution to many of these problems; and

Whereas, There currently is no requirement for the use of
returnable containers in this state, nor is there a satisfactory
system of cooperation among litter cleanup activities and programs,
disposition of waste materials and recycling activities and
programs; and

Whereas, The Legislature needs accurate information regarding
these subjects in order to make informed decisions regarding any
problems and potential solutions; therefore, be it

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is hereby
requested to review, examine and study the feasibility of requiring a deposit on certain beverage products, with specific emphasis on
the integration of such a program with county solid waste
redemption centers, infrastructure and economic viability, and
marketability
and integration into local recycling programs; and,
be it

Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2003, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it

Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
